General Terms and Conditions

Please read these terms and conditions carefully. These conditions, along with any other information given to you at the time of booking, set out the terms and conditions of the contract between you and winestories.es

- Additional agreements, special agreements and agreed special requests of the traveler must be recorded separately in writing.
- The minimum age of participants is 18 years.
- The customer will be picked up at our pick-up points. Details of the pick-up points can be found under the detailed information of the respective tour. At the end of the day, the customer will be taken back to the meeting point.
- The snacks offered on the individual tours are provided by partner companies. All questions regarding ingredients and additives must be clarified by the customer directly on site with the partner company.

Changes to the route, individual excursion destinations and the time schedule may be possible for various reasons, e.g. due to traffic jams, road closures, closure days of facilities or force majeure, and are expressly agreed. Wine Stories reserves the right to change accommodation with similar official standard and wineries visited within the wine regions selected in the Travel. A change of accommodation location or wineries to be visited is considered a minor change and has no further consequence.

Reproduction of the information provided in this portal is only permitted for personal use.

We are fully compliant with all data protection legislation. In order to process the reservations of the services contracted Wine Stories needs to collect personal data from the TRAVELER which may include sensitive personal data such as information relating to any disability or medical condition or dietary restrictions. Wine Stories would also like to store the TRAVELER data to inform about promotions, trips and tours that may interest the TRAVELER. The TRAVELER has the right to request not receiving such information from Wine Stories.

We do not store during the booking process any credit card information since this information is processed automatically by our payment providers.

A booking with Wine Stories is confirmed when full payment has been made by the TRAVELER and received by Wine Stories. Upon conclusion of the contract, 100% per person and trip must be paid in advance, before the start of the excursion. Payment is made via the online booking system.

Payment requests are sent to the customer to proceed with the booking of a service and should be processed within hours after having received it. If a customer processes a payment request and there is no availability of the service requested WT will proceed with a reimbursement of the amount paid.

You will receive a booking confirmation when you complete a booking via our website. You must present this booking confirmation to a Wine Stories employee at the meeting point. Please note that Wine Stories does not offer physical tickets. The booking confirmation must be carried during the excursion. Therefore, please keep the booking confirmation in a safe place. You may not use the services offered by Wine Stories without a valid booking confirmation.
The booking confirmation entitles you to use the services purchased for the respective tour and date specified in the service description on the Wine Stories website. Changes to bookings are at the discretion of Wine Stories. All requests for changes must be made in writing to the customer at least 72 hours before departure. If you wish to change the date of your booked tour, please note that you may have to pay a surcharge (e.g. if several changes have already been made to your booking or if the requested date/time is more expensive). Refunds are not applicable if prices have dropped due to promotions or if the chosen date is cheaper.

Any payment to Wine Stories constitutes your acceptance of these terms and condition.

We recommend the TRAVELER to check the price of the service at the time of booking to ensure there is no mistake. In case of mistake in the price provided, Wine Stories reserves the right to correct it and claim or reimburse the TRAVELER any amount and advise the TRAVELER accordingly.

Wine Stories reserves the right to change prices in case of important changes in prices or in the taxes that apply for the services contracted and which would impact the cost of the services contracted by Wine Stories. In case the Travel price to the TRAVELER increases more than 5% due to changes described in this paragraph the TRAVELER would have the right to cancel the Travel and no cancellation fee would apply. The TRAVELER would need to confirm his intention to cancel the trip at least 5 days after having been communicated this change in price by Wine Stories. The prices are subject to change without notice until the contract is concluded, also due to printing errors, changes to the offer, calculation errors, etc. The offers are only planned excursion destinations; the excursion destination and price may change for various reasons (e.g. customer request, technical reasons, etc.).

The TRAVELER has the right to change the reservation to another person in case this is indicated at least 2 days before start of Travel. This change would imply an administrative cost of 10 Euros per person impacted, provided that the third party meets the special requirements of the event and his participation does not conflict with statutory regulations or official orders. The TRAVELER and the third party are jointly and severally liable for the tour price. Wine Stories must be informed of the replacement traveler in writing (e-mail).

Wine Stories accepts its responsibility to fulfill all the elements of the tour the TRAVELER books to a high standard and with reasonable skill and care. Wine Stories does not accept responsibility for failure to enjoy your holiday where it is due to anything other than Wine Stories´s breach of contract. All the services we provide will be subject to the local laws of Spain.
Wine Stories accepts no responsibility for loss, damage, delay, inconvenience, direct or consequential loss, however caused. Access to partner companies (e.g. wineries) is subject to the general terms and conditions of these partner companies.
Any further liability of Wine Stories is excluded.

Compensation will not be payable and no liability can be accepted by Wine Stories in case Wine Stories is forced to make an important change or cancel the Travel services to be provided as a result of unusual and unforeseeable circumstances beyond the control of Wine Stories. These can include war, riots, demonstrations, epidemics, natural disasters, accidents or disproportionate road conditions, road closures as well as police decrees or similar.

Cancellations must be notified to Wine Stories in writing. The following cancellations charge would apply:

15% of the total services cost if cancellation takes place before 30 days of the start of your trip or stay. For cancellations within 30 days of the starting date of the service a 30% of the total cost will be refunded unless cancellations take place within 7 days prior to the start of your trip, in which case no amount will be refunded. We advise that you consider purchasing Trip Cancellation / Travel Insurance

Any change request made by the customer after already having booked and confirmed the dates of the trip may imply an additional administration fee of 5% and may also impact the overall trip price due to provider price changes. Cancellation of the trip may be necessary if date changes impact availability (in which case, the cancellation policy will apply).

If the minimum occupancy of 6 persons is not reached 72 hours before the start of the excursion, Wine Stories can cancel the service at short notice. In this case, the customer will be informed by e-mail. If the customer has booked and paid in advance, he will receive a full refund.
Wine Stories may cancel the excursion or service at short notice in the event of illness or technical problems or adverse weather conditions, e.g. rain or snow.

Travel insurance is not included in the Tours provided by Wine Stories. WE STRONGLY RECOMMEND the TRAVELER to contract Travel insurance prior to the start of the trip, including not only medical expenses but also Trip Cancellation insurance and other travel related losses.

We recommend the TRAVELER to provide Wine Stories with contact details of relatives or friends that should be contacted in an emergency. Please note that all costs incurred by us in providing any assistance in the event of an emergency including but not limited to payment for any transport must be reimbursed to us.

The TRAVELER will behave without creating disruption the enjoyment of others or creating prejudice to the reputation of Wine Stories. Wine Stories will terminate the service provided in case the TRAVELER is in breach of this clause and no refunds will be made or cost be paid as a result of the termination of the services.

The TRAVELER is liable for all damage and losses caused by the TRAVELER actions or those of any member of your party at any of the establishments visited during the Tour.

Wine Stoires may terminate the contract without notice and exclude the TRAVELER from continuing the excursion and assumes no further liability if, despite warnings, a customer continues to cause considerable disturbance, so that further participation is no longer reasonable for the organizer and/or the participants (e.g. offensive or as a nuisance to other passengers, or if the behavior of this person poses a danger to their safety or the safety of other passengers). This also applies if the customer does not adhere to objectively justified instructions. In this case, Wine Stories is still entitled to the event price, insofar as there are no saved expenses and advantages from an alternative utilization of the service(s). Claims for damages otherwise remain unaffected.

The TRAVELER is obliged to take reasonable steps to minimize any damage.

Instructions of the driver regarding safety instructions must be followed at all times; if this is not done, the driver can exclude the TRAVELER from transportation (without financial compensation) and there is no liability claim.
For example
- failure to wear a seatbelt
- endangering other passengers
- Other traffic hazards

These remain at all times the TRAVELER own responsibility. The agreed service does not include the supervision of passengers, especially when boarding and disembarking, the supervision of luggage, especially when loading and unloading. Therefore, please take care of your belongings.

During the excursion and when visiting partner companies, it may happen that pictures, videos or other media recordings are made in which you are depicted. You agree that such media may be used in Wine Stories marketing and advertising materials, including platforms (e.g. social media channels such as Instagram, YouTube, Facebook, Google, etc.).

Unless otherwise stated, all intellectual property on the website and all rights to all information (including screen displays, content, text, graphics) belong to Wine Stories or the respective licensor. All trademarks, service marks, company names or logos are the property of their respective owners. Any use of these trademarks, names and logos by you may constitute an infringement of the owner's rights. Wine Stories does not warrant that the website does not infringe any intellectual property rights of third parties.
You may not use any part of the materials on our website for commercial purposes without obtaining permission to do so from Wine Stories or its licensors.

Wine Stories is not responsible for the content of any linked websites. Wine Stories disclaims all warranties and liability for any loss or damage you may suffer as a result of using such websites.
